Child Support Electronic Memo
Child Support Driver License Suspension
What is the Nassau County’s Child Support Driver’s License Motor Vehicle Registration Suspension Program?
It is a form of Child Support Enforcement offered by the Central Governmental Depository of the Clerk’s Office.
Pursuant to Florida Statutes 61.13016 and 322.058, when a Payer is fifteen (15) days delinquent in making payments in child support, the Payee “MAY” upon written request, initiate the Driver’s License and Motor Vehicle Registration suspension against the Payer.
What are the qualifications for the program?
- You must have a Nassau County Order for child support payments.
- You must not currently be under contract with the Florida Department of Revenue Child Support Enforcement Program.
- Payer must have a Florida Driver’s License.
What information will I need to provide to the Central Governmental Depository?
- Payer’s name
- Date of Birth
- Child Support case number
- Payer’s last know address, if possible
- A written request asking for the Driver’s License and Motor Vehicle Registration to be suspended due to delinquency. You can access the form online or in person at the Civil Customer Service Department at the Nassau County Judicial Annex or at the Nassau County Historic Courthouse.
- There will be a $3 charge if the form is attested by a Deputy Clerk.
How does the Program work?
The Payer will receive written notification of the “Notice of Intent to Initiate Driver’s License and Motor Vehicle Registration Suspension” at his/her last address of record with the Department of Highway & Safety Motor Vehicles.
The Payer has three options to avoid Driver’s License and Motor Vehicle Registration suspension:
- Pay the Delinquency in full and pay the $10 delinquency fee per F.S. 322.245(2).
- Enter into a written agreement for repayment of the delinquency with the payee and pay the $10 delinquency fee per F.S. 322.245(2).
- File a Petition for hearing with the court to “Contest the Driver’s License and Motor Vehicle Registration Suspension”. (Payer is responsible for any filing fees charged by the Clerk’s Office and pay the $10 delinquency fee per F.S. 322.245(2).)
If the Payer fails to select one of these options within twenty (20) days from the date of the Notice of Intent to Suspend Florida Driver’s License and Motor Vehicle Registration, the Central Governmental Depository office will forward a request to suspend the Payer’s Driver’s License and Motor Vehicle Registration to the Florida Department of Highway Safety and Motor Vehicles.
After a Driver’s License and Motor Vehicle Registration has been suspended, they cannot be reinstated until all fees for reinstatement are paid, the child support delinquency is paid in full or the Payer and Payee enter into a written agreement for repayment of the delinquent child support monies.
